There’s a Supreme Court case from decades ago that upheld a dui. Guy started his car, then passed out. Cops found him in the drivers seat with engine running. Convicted of dui. Court said that they defined him as the vehicles operator even if it wasn’t in motion.
Plus a lot of states anymore don’t write it up as Driving under the Influence but Operating under the Influence

Absolutely. When my son was stationed in Kansas years ago I was talking to a young guy there.
He had multiple Dui against him. Told me he was drinking came out got in his car no keys to get something from the car
It was on the property not running no keys . They hit him with another Dui and it stuck.
