That would be ok if the pipes hadn't been compressed by the U clamp. To do it so it doesn't leak or loosen, you need to leave a U-clamp on there or you need to cut out that section and put in a new clean section. That would require welding or additional band clamps.

Got the clamp today put it on and it fit good. Tightened it down with the bolts positioned to the side for ground clearance and it is tight as hell and not going anywhere. Also, the u bolt clamp was leaking slightly but the band clamp is not leaking a bit. I'm pretty happy with how it turned out. The small ridge the u bolt clamp put in the pipe didn't hurt a thing since it was in one small area on the larger pipe. It still sealed fine.Now it has plenty of room between the pipe and the cross member so as not to rattle.
