Just a bad brake or Cop

Hi guys, being in the gerneral discussion what the hell. Rian and I are alittle pissed today. (more money gone for mopar parts). Rian decided to leave the duster and take his bike out for a ride through Victoria. He was pulled over for by a cop for "obstruction of plate" which came with a $200.00 fine and 3 points. He said the cop walked up to his bike one foot away and said, I can't see your plate. :knob:. Rian said he was polite, however the cop continued to ram his stick down the muffler to ensure there was a baffle :tool:. Apparently the cop was going in the other direction when they turned around? Here's a few pics I took of the bike, One is from inside sitting inside my car at 4 feet away, 2nd is just behind, 3rd is from a 30 degree angle and last from like another driving lane. What do ya think. Pay the piper or go to court :-({|=

Motor Vehicle Act Regulation 3.03
Prior to July 19, 1996, it read:

3.03 A number plate must be kept entirely unobstructed and free from dirt or foreign material, so that the numbers and letters on it may be plainly seen and read at all times and so that the numbers and letters may be accurately photographed using a speed monitoring device prescribed under section 83.1 of the Act.

I would try to fight, but I can see how the shadow could make the plate hard to see. I'm pretty sure all the plates in the US are right under the brake light, so I am not sure about the laws in Canada. Could depend on the cop or even city. Town near where I live will issue tickets and huge fines for factory tint on windows especially if it is on front drivers and pass. windows, seriously factory tint not just aftermarket.
 
must have been a BLIND cop!!!!...OR the SUN was in his eyes!!!!...OR the MOON was in his eyes!!!.....OR he forgot to wear his eye glasses!!!! =;

as for the bike plate i have seen them in the same location from the factory. mainly high end bikes like ducati.... i would try and fight it.
 
The plate must be lit up by the factory light which is usually part of the brake light assembly, at least that's the law here and I am pretty sure it is the same everywhere. Having said that, your plate does seem to be visible, but at night it may be different. Seems like a trivial point.
 
Hey, BAD don't put all of us in the stupid column. It usually takes a stupid act to get a vehicle impounded!

hope i didnt offend any cops here, i got pulled over in the parking lot of my job cause the brake lights didnt work (the switch), impounded cause i didnt have my insurance or registration on me, although i do have it, just that i cleaned out my car and have it all in a shoe box for now. So its gonna cost me a lot to take it out cause they charge outragous prices at impounds, and i have to wait a few days until i can actually go do this, cause the clerk is only there certain days. To make things worse, a customer told me he saw the tow truck driver pull my dart off the truck and into the impound lot and he was revving the hell out of it several times, its just a few blocks down the street from my job. So i got these guys having fun with my car, I passed by after work and the hood is popped open. so all my experiences with them have been bad, but the city has to make its money somehow i guess...i really dont care much about them, firefighters are cool though
 
Bad, I wasn't offended.That sounds a little harsh to impound your car. It was proably dictated by the local goverment's policy. Here we would have issued a citation and then voided it with proof of reg. and insurance. Of course we could not let someone just drive away.A lot of folks are injured by uninsured drivers each year.Why not go to court and explain the situation, might help. About all the cops here are into cars, even the Sheriff has a bunch of brand x muscle cars and a Super Pro bracket car.

Guys, the last thing I wanted to do was start a harsh thread. I personnlly don't mind cops...I just thought maybe this cop was a little "I hold the gun routine" wrong place,wrong time. If my kids wrong he "should" pay the piper. Perhaps he's stupied even to move the plate inthe first place....Like "we" have never modified anything within reason? Anyways perhap the cop had a bad day. If anything..a warning ticket to change it back would have at least been cool. It's not like he didn't have a plate at all. I'm just POed becouse you can get a less charge for speeding that can kill..not a plate..Thanks for your input.
 
It's obvious the plate is not mounted where the factory put it and at least in the US won't meet federal regulations. I would say you are walking a fine line there, it's not obscured in the pictures but placing it up under the seat is an attempt to hide it. The cop has obviously had bad experiences with sport bikes and went over board (here in Mass that would get you a $50 fix-it ticket , that is have it corrected and signed off by an inspection station and the ticket is retracted) and could have been charged himself with destruction of property by poking a night stick up the muffler.

I would fight it but first I would re-install the proper mount and put the directional signals back on the bike and bring the bike and some photos to court. Claim ignorance of the regulations and show that you fixed it.

I find it amazing that you would even get driving points for a non-moving violation.

Good point dgc333, that's what I will have Rian do. Walking that fine line can depend on the cop. Some laws up here are screwed, IE..We can't have those blue neon buttons on your tail lights because the law says red only, however just about every 50-60s veh have them in. Thanks for your advice.
