I just sold a car to an out of state buyer & after recieving the car he is not happy with it, thinking that I screwed him: radio/gauges don't work, has rust, brakes pull to right, fuel stale. I bought the car & only drove it once or twice then it has set for at least a year & it drove OK & no pull that I remember & I didn't notice the gauges not working. all I posted is that it runs/drives well which it did for me & I took alot of pics of it tho not of the underside which I am assuming is where the rust it. I lost interest in the car when I bought it & never did anything with it. he wants a partial refund. Am I at fault here? Thank you for your time. RR
 
Did you include an "AS IS" bill of sale? That always goes with used cars.

I sold a 08 Chrysler Pacifica to a young lady last summer. It had been my daily for the past several years and it was time to upgrade. I wasn't going to pay to fix the A/C.
The girl bought the car cheap. In fact, all I really did was recoup the amount I had in it for a recent water pump/timing belt job and a set of tires.
She drove it around a couple thousand miles and water tube leaked and I guess she over heated it.
She and her dad were at my door wanting her money back.
I told her no. I had no idea what she had done to the car after it left my control. I had no way of knowing that a water tube would leak, and why didn't she get it fixed instead of driving it with a leak.
In the end, I, like you conducted a sale in good faith. The car was sold as is where is. I'm sure you gave your buyer the opportunity to drive or inspect the car before they bought it. If they didn't, then buyer beware.
 
I have a hard time sympathizing with someone who didn't come and check out the car. If you properly described the condition of the car I wouldn't worry about it.
 
I sold a car a number of years ago that had some issues, all of which were disclosed in the advertisement, including the overdrive function not working, and it needed a new alternator. Woman came to buy it, was all excited about getting a running car for $400.00, I explained clearly what was wrong with it, and she said she understood that and it was fine.
A week later she calls me and is pissed about the costs of fixing it, etc, demanding that I refund her money. I highlighted the part of the bill of sale that said 'sold as is where is' and sent her a picture of that, along with a message that I would see her in court.
Never heard from her again.
 
I did not post/give an AS IS bill of sale & it was an out of state purchase so he went by my descrip/pics I posted. EDIT this is my 65 dart I just advertized on here. I had given ~18K for it. I posted 11K for it which I thought was fair. the guy wants $5500 refund saying it had too much rust & other issues that I did not disclose. I only drove the car twice & never inspected it/pretty much just lost interest in it right from the getgo (other issues came up). the guy gave me $9700 for it. If I owe him I will pay him. RR

For any of the stuff the buyer is complaining about, did he care to ask about those before the purchase?

Brakes pull to the right? Stale fuel?? REALLY??? What did he want, a fresh full tank of 93oct?
 
I can imagine a judge looking at this....your word against his, used car and he didn't look at or have it inspected. I'd call his bluff and let him go to court.

You don't owe him a penny. Stop worrying about it.
 
I understand totally. It's a honor/ pride thing that's bugging you. But you already dropped the price alot. Then he doesn't come look at it and pulls the trigger buying it. His fault. Now he wants 5k off on top. Get the f out of here. At that amount you may as well gave him the car free. He thinks he has you by the balls now cause he has the car. I say good day sir and move on
 
I consider myself to be straight up & I dont want to get over on anyone. I told him about the drivers door latch needing adjustment for the door to shut clean & the hood latch needs to be held "open" as you shut the hood. I did not tell him about the faulty driver door armrest. that's all I could think of of. first time when we talked he expressed his unhappiness with it with a long list of its faults & wanted to reverse the deal & for me to relist it & send em to his address to pick it up, then he said he wanted to keep it but get a partial refund. I asked him how much & he said 5500. he said the body was junk & the only value was the drivetrain. the car is in the "mopar cars for sale" section & I think I asked 13K not 11K as I posted earlier when I went back & checked the ad. if you would like to view it. thanks guys for the comprehensive help on the stressor.

But in the future, do yourself a favor and add in the "AS IS WHERE IS" clause. Perfectly legal and it can protect you.
 
I don't want to come across as a hack or a scammer but I have to state the following:
I've sold cars on ebay and never aimed to get rich from it. I built a few A bodies and made a little money on each one. Most of the benefit that I got was the fun of the build. Some people really work the rules to take advantage of others with ebay sales. It seems like the buyers are given all of the rights with the sale.
One guy bought a Dart Sport and contacted me about a few small items that I legitimately missed so I sent him a box of parts to correct the mistake.
Another guy bought a car that went across the country to what turned out to be a used car lot. The buyer bitched up one side and down the other about things that were NOT an issue when I had the car. He didn't make any threats but according to ebay, he could have. I could have been on the hook to refund his money and pay for the shipping BOTH ways to get the car back. The car barely made the low reserve I had set so this would have been a real shitty deal if he pushed matters. The man knew what he could get away with and used it to his advantage. I ended up refunding some money and he never contacted me again. THAT was a shakedown that I had no choice but to go along with.
Ebay is ****. They don't care at all about the sellers. I've sold two cars after that debacle and was extremely clear about everything. One had a $5000 reserve but bid to $9000. Why is it that the highest bid didn't result in the buyer being the more picky one? No.....It had to be the assclown that barely made the lower reserve. It is the cheapskates that still think they deserved more.
