Unhappy buyer .What to do ???

Just wanting sum advise here .I sold a third memeber to a fellow member across the country a few months ago.This was a spooled 8.75 chunk that i had made a handfull of low 7 second passes with in my car.The gear ratio was too low for my set up ,so i went back to my old chunk.

I made it very clear in my ad the the chunk was used for about 10 passes ,but was a rebuilt unit prior to that,and was in good working order in my car when i pulled it back out.

I got a pm today after 2 months of silence from the buyer.He told me that he had it checked out and under the opinion of the guy that checked it out ,it wasnt "broke in properly" and the gears are no good ,even though they look good to the eye.

He is asking me for an adjustment in the form of $$ .I dont feel im in the wrong and i described it as best i could in my ad ,and it was as i decribed it .I dont want members thinking im shadey ,but i dont feel i wronged him .What would you do ???

Do you have a link to the sales thread? It would be easier to give a honest opinion if the details of the transaction were read.
 
What Okla said, and were they noisy at all,..

Did you ever check the tooth pattern, and I'm sure you did,, did you get a good pattern??
 
Used race parts are just that,, USED If he wanted new That's what he should of bought. I can't see even if set up wrong and the pattern was off,, other than being noisey it's a race car. If the back lash is in limits I see no problem.Now if the heal or toe is way off that it may break the teeth,,,It would have happened to you. Just a thought...
 
I did not set the center section up and i made that clear in my ad and to him.I bought it rebuilt and already set up .The contact pattern of the teeth ( by the obvious normal wear )looked good.There was absoulutly no noise at all from it ,but keep im mind this was a race car ,not a cruiser application .I made that clear to him as well ...
 
I bought this chunk a few years ago to try the ratio and it was too low for my combo ,so i pulled it out ,cleaned it up ,and put it away.It was a fresh rebuilt unit when i bought it and i only made about 10 low seven second passes with it ,so i would say its still in great shape .Its the desirable "742" for the 8.75 Mopar rear .It has 4.86 Richmond gears ,and a 35 spline Moser spool .All the seals ,bearings ,the gears,etc were new when it was professionally set up.It worked fine and the wear pattern on the gears looks perfect.I am about 70 miles North of Dallas Texas ,and i would prefer local pick up .I am willing to ship ,but please dont ask me to haul it down for shipping qoutes unless your ready to buy .Im guessing it will be $90-$100 to ship in the US by its weight .I will take $475 plus shipping for it as its ready to drop in and race ...

This would be tough to call. I would take it that you represented this as a 100% part. I think I would talk to the guy that says the gears are no good and see what his qualifications are. If he isn't a professional then maybe one should look at it.
 
I imagine 486 gears had a little noise but making 7 second passed he didnt here it. I think you sold them on the up and up. Just my opinion.

Interestingly, I just purchesed a set of gears from a member,, used,, and when I install them,, if they're noisy,.. I won't say a word..,

If there's chunks off the teeth,, I likely will...

It sold for less than the original ad because he cut the price several times.

I sold it for $375.00 plus shipping .He said the guy that checked it out told him it was okay to use as a spare ,but didnt turn as easily one was as it did the other ,so that meant the gears were bad or something.He told me this guy has been doing gear setups for decades .We talked through pm's before he bought it and i asked him if there was anything he wanted me to check or verify that i hadnt mentioned ,and i would do my best to get him what he needed.I made it clear that i am no expert in gear sets ,but the wear pattern looks good and it did ...
 
one day chicken the next day feathers hope ya'll can come to an agreement the ad was pretty clear it is a used racing part
 
I have to agree with everyone else. The most oustanding line in your thread is, the fact of how many passes you had made on it already and by stating appearance only visually it looked ok.. So no one can fault you for mis-representing this part as new and unused.. Let this person go out and price a whole new centersection in comparison to the "used one" you sold him. Besides if your going to buy used parts always be prepared to find, fix, or replace pieces and parts until you get it as good as new for yourself..

I don't see anything to complain about because it was a used part, even his guy said it is ok to use as a spare so it can be installed and used. That being the case I would say he should have bought it new if he expected a new part.

Just the fact that you show this much concern to make it right, you are on the up and up.
It's always the guy that beats you up on the price. Tell him to box them up, and he pay's to ship them back. Then refund all the money MINUS the shipping to and from.How much more fair is this?
Then resell them on Ebay, and get more money from them. I have sold sets like this for $500.00+

I bought a set of completely fresh rebuilt X heads a few years ago and the valve clearances were very bad (paid high dollar $600+). I had new guides installed and wrote it up to buying something sight unseen off the internet and moved on. I agree if there was no obvious visual damage and they were not set up properly that was the chance he took buying used at a good price. No need to make $ adjustment.

Used parts to me are sold as is!
When I purchase a used part, I look at what I have to lose & compare it to a new piece.
No one twists my arm to buy a used part.
I do base it off the information provided, be it an ad or speaking with the seller.
Even then, its a gamble & you have to be ready to accept it as a life lesson if it fails or doesn't meet your expectation.
Judging by your ad, I would have bought it.
Giving the guy a refund is up to you, but the buyer would have to pay the shipping frt. back to you.
You would then need to inspect it for correctness, some people may try to cheat you.
I would only refund the purchase price & the buyer should feel fortunate to get any refund on a used part.
 
Thanks guys.My gutt told me the same thing ,but just wanted to make sure i was thinking right.I sent him a reply back and politely told him that i dont think i owe him any $$ adjustment.Please keep in mind the man was not rude or demanding to me in his pm ,so i treated him the same.He even told me that i accurately described it ,but the problem was not seen by a visual inspection (basically thats how he said it )...
 
Used parts are used parts,and it,s a roll of the dice.If the buyer does not show a tooth pattern wear on the gears and you have used them with no problems,you owe ZERO.If he can not come up with the SO CALLED tech that looked at the gears,and his number,to talk to him,he COULD be scamming you.Was there some sort of noise,high pitched humming,noise on costing,if not,he has no leg to stand ,mrmopoartech
 
Lots of professionals out there lookin at stuff and really they wanna sell parts too.....that gearset could go for two more runs or two hundred...its metal stuff it's gonna go till it's broke the price was more than fair description was good don't base what you do on our opinion...do what your gut tells you...thats what makes you ....you we cant see the part or the problem with it...I have a feelin I have dealt with this person before and he's a straight shooter...the person that lloked at the part may not be so or may be a nit picker and that happens theres an *** for every seat, based on what was said I'd run that gearset but my car don't run in the sevens so I'd never break it..I've had gears that howled like wolves and never broke but I wasnt runnin that fast, ask him what he thinks would be fair???? see if it's worth it to make this go away??? JMO

I,m having a hard time understanding why it took him 2 mnths to complain.He may have had them in his car,made a few passes and didn,t like them.After talking you down on your price,then complaining 2 mnths later also with them being used parts...Sold as is.After 1 week maybe,after 2 months he owns them.JMO

you didnt misrepresent the gears as new. it sounds like the buyer wants a different ratio or just brand new gears and is trying to get assistance.

that should not be your responsibility, since you were not selling new gears. you were selling used gears that your portrayed as usable. not perfect.
