I paid for my property and never had a mortgage on it Mitch, I have the release from back in 2006 when the seller sold part of it to me, I have all the track and land location and had it servaide (how ever it is spelled) but this bank sold the land owner's loan he made in 2008 to to another bank #-o The bank that bought his loan did not look closely into his deeds and land ownership and just seen he had what he owned back in 2004.. if they looked farther in to his loan and ownership papers they would see they cant put a judgment on my property becouse I own it, it give me a head ace trying to explain #-o In short I do indeed own my property and they over looked the loan papers at the new bank, they screwed up! and me trying to talk to someone way up north in N.J. has been an imposable feet ! This all went bad when a bank sold an old loan to another bank :banghead:
Here is where your problem probably is.........
When you made the transaction with the original owner did you have a title company invovled?
Just because you hired a surveyer and sectioned off the tract of land titled in your name does not mean there was not an claim by a crediter existing.
That is why a Title company would be a neccessity in real estate transactions.
Very well could be a legitamit claim that was not uncovered due to the small amount of money saved by not involving a Title company.

I realize in your part of the world things are done differently than the rest of us.
My in-laws in Mammoth Spring are building a house with out prints (Contrctor building off a graph paper drawing produced by my mother in law ...LOL), no permits, inspections, impact fees etc.
